Notice of a Right to Lien

Why It’s Important

In many states, you have the right to file a lien if you’re not paid for labor, materials, or equipment provided on a construction project. However, you must first send a Notice of Right to a Lien and follow the proper steps. Late giving notice may secure some, but not all, of your lien rights.

We cover all states specializing in Oregon and Washington.
It is a Notice to inform the property owner that you are working on their property or providing materials, supplies, or equipment to their property; and if you are not paid in full for your work on their property or the materials, supplies, or equipment provided to their property (even if you do not have a direct contract with them), you have the right to place a lien upon their property

The time frame for filing a Notice of Right to a Lien varies by state. In Oregon, notices must be filed within 8 working days of when work begins or materials are first provided. In Washington, notices should be filed within 10 calendar days. These notices inform all required parties on the job site, including property owners and lenders. BMDA ensures your notices are filed within the required timeframes to protect your lien rights.

A contractor or material supplier who wants to secure their claim for payment for the providing of labor, materials, equipment, or services to a construction project must file their construction lien within 75 days of the earlier of when: (1) the contractor or material supplier ceased to provide (substantial completion of your work) labor, materials, equipment, and services to the improvement; or (2) the project is substantially complete.
A construction lien in Washington must be filed for recording not later than 90 days after the person has ceased to furnish labor, professional services, materials, or equipment.
